Vehicle Rental Terms and Conditions - Go Drive


1. OBJECT

Go Drive rents to the Customer identified in the specific conditions of the contract (hereinafter referred to as "Lessee") the specified motor vehicle, in accordance with the conditions stated in the contract and with the following terms and conditions.


2. DELIVERY AND RETURN OF THE VEHICLE

  1. The Lessee declares that at the time of pickup, the vehicle is in good condition and clean, without apparent defects, accompanied by the respective equipment, accessories, and documents, and undertakes to return it in the same condition as received, at the location, date, and time designated in the contract.
  2. If the vehicle is used in violation of the contract, Go Drive may terminate the contract, requiring the Lessee to immediately return the vehicle at the indicated location, under penalty of the vehicle being seized, in accordance with the law, with the Lessee responsible for all expenses.
  3. If the Lessee wishes to extend the rental period, they must contact Go Drive to verify the possibility of extension and be informed of the conditions in effect at the time of the contractual change, which is subject to approval.
  4. Go Drive is not responsible to the Lessee or any passenger for loss or damage to objects left in the vehicle, either during the rental period or thereafter.
  5. Flexi Early Return: In case of early return, the Lessee must inform Go Drive at least 12 hours in advance, under penalty of a fee corresponding to 50% of the value of the unused days.
  6. Flexi Late Return: In case of return after the contractually fixed date, an additional daily fee of €12.30 (twelve euros and thirty cents) will be added to the prevailing daily rate.
  7. Flexi Return Location: If the Lessee returns the vehicle to a rental station different from the originally agreed one, within a perimeter of 50 km, without prior notice up to 12 hours before the vehicle's return, a fee of €19.68 (nineteen euros and sixty-eight cents) will be applied. If the return occurs at an airport station, an additional surcharge of 12% of the total rental price will apply.
  8. After-hours and weekend return fee: In case of return after business hours, a fee of €45 will be added.

3. VEHICLE USE

  1. The Lessee must ensure:
    1. That the vehicle is properly locked and parked in a safe place when not in use.
    2. The use of appropriate fuel.
    3. The diligent connection and use of any security device installed in the vehicle, if any.
    4. That the vehicle is used prudently and carefully.
  2. The Lessee undertakes not to use or allow the use of the vehicle in the following situations:
    1. To transport passengers or goods in violation of the law.
    2. For participation in sports events or training, whether official or not.
    3. To tow or push any vehicle, trailer, or other object.
    4. By any person under the influence of alcohol, drugs, or any other substance that affects perception and reaction ability.
    5. By unauthorized drivers, i.e., not identified in the contract or annexed document.
    6. Outside Portuguese territory, unless express authorization has been obtained from Go Drive and the Cross Border fee has been paid.
    7. For any illegal use or purpose, contrary to traffic rules or current legislation.
  3. A daily surcharge of €9.51 (nine euros and fifty-one cents) applies for young drivers under 25 years, up to a maximum of 10 rental days.

4. VEHICLE MAINTENANCE AND REPAIR

  1. Any necessary repair or maintenance of the vehicle will be carried out exclusively by Go Drive, with the Lessee required to inform them of this need as soon as they become aware of it.
  2. The Lessee is solely responsible for any damages caused, even if due to negligence, without prejudice to the provisions of the previous numbers. In such cases, the Lessee is responsible for paying the following expenses:
    1. Repair and/or restoration of the vehicle's condition.
    2. Compensation corresponding to the period of vehicle downtime.
    3. Towing, amounting to €100.00 (one hundred euros) within national territory and €800.00 (eight hundred euros) abroad.
    4. Transportation to the nearest airport station for picking up a replacement vehicle, in the amount charged by the service.

5. SERVICES

  1. The Lessee benefits from a 24-hour roadside assistance service during the rental period at no additional cost, which operates in case of vehicle breakdown and/or accident occurrence. Assistance includes, as necessary, the following services:
    1. Towing or removal of the vehicle.
    2. Transporting the Lessee and vehicle occupants to the Go Drive station or designated location.
    3. Replacement vehicle.
    4. One night hotel room with breakfast, up to a maximum amount of €65.00 (sixty-five euros).

6. INSURANCE AND COVERAGES

  1. The rented vehicle includes mandatory civil liability insurance coverage.
  2. The Renter may opt for additional coverage, as described below:
    1. Basic – Includes Third-Party Insurance and LDW (Loss Damage Waiver), with an associated deductible amount, as specified in the contract.
    2. Flex – Includes Third-Party Insurance, LDW (Loss Damage Waiver), and offers a 70% reduction in the deductible amount.
    3. Full – Includes Third-Party Insurance, LDW (Loss Damage Waiver), full deductible reduction (0%), TWL (Tyres, Windows, Lock), coverage for windows, tires, and locks, (Interior Protection) interior protection, and PAI (Personal Accidents Protection) personal accidents protection.
    4. TWL (Tyres, Windows, Lock) – Covers damages to tires, windows, and locks (excluding rims and rear lights).
    5. International Insurance (Cross Border) – Covers the vehicle in case of travel outside the country of origin, subject to specific restrictions in the contract.
    6. PAI (Personal Accidents Protection) – Includes health expenses, with a maximum amount of €1,500.00 (one thousand five hundred euros) in case of illness or hospitalization due to a road accident during the rental period, and up to €15,000.00 (fifteen thousand euros) in case of death or disability.

7. PAYMENTS

  1. The Lessee expressly undertakes to pay all amounts due under this Contract as soon as they are requested by the Lessor, namely:
    1. The rental price of the vehicle, based on the rental period and respective mileage calculated according to the rate stated in the Contract;
    2. All charges related to deductible suppression, personal accident coverage, collision, rollover, and theft coverage, and any other applicable expenses in accordance with the tariff or fees stated in this Contract;
    3. All taxes and fees levied on the rental of the motor vehicle or the amount set by the Lessor for reimbursement of these taxes;
    4. All costs borne by the Lessor arising from the collection of overdue payments by the Lessee as a result of this Contract;
    5. If the Lessee does not contract the prepaid fuel service and does not return the vehicle with a full tank, they will be charged the refueling costs from the nearest fuel station to the return desk, as stated on the General Directorate of Energy and Geology website at [http://www.precoscombustiveis.dgeg.pt]( http://www.precoscombustiveis.dgeg.pt), plus a fee of €30.00 (thirty euros) for operational costs;
    6. An electric recharging fee of €30.00 (thirty euros) will be charged whenever the vehicle is returned with an energy level below 80%.
  2. Any invoice not paid on the due date will accrue interest at the maximum legally permitted rate.
  3. The Lessee, to guarantee the fulfillment of the obligations arising from the Contract, will provide a credit card deposit, for the amount referred to in the Contract, also expressly authorizing the Lessor to debit on it all amounts due under this Contract, after timely notification.

8. ADMINISTRATIVE EXPENSES

If the Lessor is notified of any infraction or illegal conduct by the Lessee, and even if only to identify the same, the Lessee undertakes to pay administrative expenses amounting to €35.00 (thirty-five euros) for providing information to the responsible entity. The same amount of €35.00 (thirty- five euros) will be applied in the event of an administrative process for damage analysis and collection.


9. CONVENTIONAL DOMICILE

The parties agree to the addresses indicated in the Contract for any contact, particularly for citations or notifications.


10. PERSONAL DATA PROTECTION

  1. The personal data provided by the Lessee and the driver(s) will be collected and processed by Go Drive, the entity responsible for its processing, and is intended solely and exclusively for the following purposes:
    1. Execution and fulfillment of pre- contractual and contractual obligations, particularly for managing vehicle reservations and rentals;
    2. Compliance with legal obligations;
    3. Management of the contractual relationship with the Lessee and the driver(s), particularly for administrative and/or operational contacts, including processing vehicle damages, accidents, and traffic violations;
    4. Management and loyalty of the Lessee and the driver(s), including through bonuses and offers.
  2. The personal data provided will be kept for the minimum period strictly necessary to fulfill the purposes stated in the previous number and in accordance with the privacy policy, being deleted once they are no longer necessary, or at the end of the maximum retention period.
  3. Go Drive treats the personal data provided by the Lessee and the driver(s) with the utmost confidentiality, implementing technical and organizational measures to protect the personal data against accidental or unlawful destruction, accidental loss, alteration, dissemination, or unauthorized access.
  4. The personal data provided by the Lessee and the driver(s) may be shared with Go Drive's suppliers or service providers solely and exclusively to pursue the purposes identified in this clause, ensuring that such entities are also equipped with technical and organizational measures to guarantee the total protection of the Lessee's and driver(s)' personal data and that they will only process the data to fully comply with the identified purposes.
  5. The Lessee's and driver(s)' data may be shared whenever it is found that they committed an infraction or violation during the rental period.
  6. Go Drive guarantees that it will never sell, lend, or transfer the Lessee's personal data to third parties without the express and explicit consent of the same for this purpose, also undertaking to collect the Lessee's and driver(s)' express consent for the processing of personal data for purposes other than those described in no. 1 of this clause.
  7. The Lessee and the driver(s), as data subjects, are guaranteed the right to access, rectify, and delete their personal data, as well as the right to limit the processing, oppose such processing, and request the portability of such data. For this purpose, or for any clarification related to the processing of their data, they can contact the Data Protection Officer via email at dataprotectionofficer@godrive.pt. If they believe that their data has been misused, they can always file a complaint with the control authority - Comissão Nacional de Proteção de Dados (www.cnpd.pt);
  8. By signing this document, the Lessee confirms that they have read and accept Go Drive's Privacy Policy, which is always updated at www.godrive.pt.
